Private Property Enforcement

Property owners, managers, or authorized representatives can request police enforcement on private property for activities such as trespassing, loitering, panhandling, or other violations of law.

Who Can Submit a Request

  • Property owners, business managers, or individuals with authority over the property.
  • Only individuals listed as the Authorized Representative on the form will be recognized for enforcement requests.

What the Form Authorizes

  • Police patrols of the private property listed.
  • Enforcement actions only on private property.
  • Lawful remedies under Delaware law, including:
    • Removal of trespassers
    • Prohibition from returning (“barment”)
    • Prosecution under applicable laws

Important: Enforcement does not extend to public property adjacent to your business. Activities such as panhandling or loitering on public sidewalks or streets may be protected by law and cannot be enforced under this form.

When to Submit

  • Submit the form before requesting enforcement for recurring or ongoing issues.
  • Temporary or one-time issues may also be reported via standard police dispatch procedures, but submission of this form provides documented authorization for ongoing enforcement.

Responsibilities of the Authorized Representative

  1. Accurately complete all required fields on the form.
  2. Provide current contact information for follow-up.
  3. Understand that police intervention is limited to lawful enforcement on private property only.
  4. Notify the police if conditions change or the property is sold/managed by someone else.

What Happens After Submission

  1. The Police Department reviews the form to confirm authorization and legal sufficiency.
  2. Patrols are conducted on the property based on need, safety concerns, and available resources.
  3. Enforcement actions are documented by officers in accordance with City policies and state law.

Additional Guidance

  • Keep a copy of the submitted form for your records.
  • Clearly post “No Trespassing” signs where enforcement is desired; this strengthens legal authority for removal.
  • Police will respond to violations in a manner consistent with law, public safety, and department policy.
